This Privacy Policy explains what information Next Audio Labs, LLC. and its related entities (collectively, “Next Audio Labs”, “us”, “we” or “our”) collect from you, through our interactions with you and through our products and how we use, disclose and protect that information.

It also explains your options around our use of your personal information and how you can access and update this information.

What does this privacy policy cover?

The Privacy Policy applies to your use of Next Audio Labs’s websites, products and services (collectively, “Services”). Please also see the Next Audio Labs Websites Terms of Sale, Refund Policy and any End User License Agreements that apply to the Next Audio Labs products you are using.

Who we are

Next Audio Labs, LLC. is a California Limited Liability Company based in Aliso Viejo, CA in the United States. It was founded in 2012 by Didier Malenfant (aka Damien Sirkis) and is to this day mostly run and managed by him alone (although some contractors sometimes help with coding, moderating the forums and answering support questions). What personal data we collect and why we collect it

Next Audio Labs collects information to operate effectively and provide you with the best experiences. Personal information is collected directly from you and other information is collected when you interact with our websites, products and services.

Personal Information

Personal information is any information about an identifiable individual and is collected directly from you. Personal information you provide us may include information such as your name, email address, billing address, telephone number, personal profile and payment details.

Next Audio Labs may collect personal information directly from you when you:

  • Purchase or subscribe to products
  • Download our software or other content

You can always choose not to provide personal information to Next Audio Labs, but if you choose not to do so, in many cases we will not be able to provide you with our products or Service, or respond to any queries you may have.

Next Audio Labs may combine personal information with other information that does not, on its own, directly identify you (“non-personal information"). For example non-personal information such as which parts of our websites you have visited may be associated with your Next Audio Labs account. This allows Next Audio Labs to provide you with a more personalized experience such as keeping you up to date with relevant product releases, content and sales via marketing communications (with your consent). If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined.

Next Audio Labs Websites

We collect information when you use our websites. We may collect information sent by your browser to our servers whenever you visit a Next Audio Labs website. For example your browser may tell us your IP Address as well as browser type and language, URLs of referring/exit pages, operating system, time/date stamp, system configuration information and documents and files that you downloaded. We also may collect information about how you use our websites, such as which parts of our website you have visited, by using cookies and similar technologies.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

Visitor comments may be checked through an automated spam detection service.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.
Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

Next Audio Labs Products

We collect information when you use our products. The following types of information may be collected:

  • System information such as operating system, processor, and computer type
    Product information such as product/license type, product version number, MAC address or serial number of your computer and hardware connected.
  • Error reports and performance information such as where the error happened in the software and system or software performance before and after the error occurred.
  • General usage information such as features used, devices connected and length of time using the product.
  • Anonymized info regarding your music collection when stored in our products such as artist names, genres or other track info.

Certain information that we collect when you use Next Audio Labs Products is absolutely necessary in order for us to provide you with our Service, such as whether you are on a trial or full license, what type of product/license you have and if compatible hardware is connected. You won’t be able to opt-out from the collection or processing of this information.

Information we collect about how you use our Products (including system information, certain product information and general usage information) can be used to provide you with a more personalized experience, provide feature usage data to the products team to help improve the product and to improve support. Next Audio Labs Products may allow you to opt-out of sharing information about how you use the Product in the setup or settings panel of the relevant product.

Emails

Emails we send you may include a technology (called a web beacon) that tells Next Audio Labs whether you have received or opened an email, or clicked a link in the email. Marketing emails we send you may be tailored based on your interactions with our websites and products. If you do not want us to collect information from Next Audio Labs emails, or you don’t want to receive Next Audio Labs’s marketing emails anymore, you can unsubscribe by using the unsubscribe link within each email or by changing your notifications settings when logged into your Next Audio Labs account.

Next Audio Labs online advertising

Next Audio Labs may work with third party advertisers such as Google that use cookies and similar technologies to provide more relevant advertising about Next Audio Labs products and services on our website and across the internet. We collect information such as, which ads are shown, clicked on and where the ad was displayed.

Next Audio Labs does not store your credit card details

Any payment information, excluding name and contact details, provided by you is not stored by us. Purchases from Next Audio Labs, either on Next Audio Labs’s websites or in-app, that require the inputting of credit card information use specialized credit card payment services like Paypal or Stripe, for the purposes of processing credit card data.

Next Audio Labs Online Community

Next Audio Labs websites include the Next Audio Labs online community areas such as the Next Audio Labs blog and forum. Next Audio Labs works with service providers and business partners that support our Services. We may work with these companies to provide services including customer support, processing credit card payments, and sending marketing communications. Next Audio Labs is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use or disclosure. We store the personal information you provide on computer systems that have limited access and are in controlled facilities. For example Next Audio Labs websites are hosted with SiteGround, which has data centers located throughout the world. This means your information may be transferred across national borders.

While no service is completely secure, Next Audio Labs takes reasonable measures to help protect information about you from loss, misuse, unauthorized access and alteration. For example, we ensure that our third-party data center vendors provide adequate security measures. In addition, your data is protected with encryption, such as Transport Layer Security (TLS) or Secure Sockets Layer (SSL), during transition over the Internet.

Information retention

We retain personal information we collect from you where we have an ongoing legitimate business need to do so (in connection with the purposes set out as above).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives). then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Transfer of information

We may transfer your personal information across national borders to other countries in compliance with applicable laws. If you are from the European Union or other regions with laws governing data collection and use, you hereby consent to the transfer of your personal information to outside of the European Union (or from your country, as applicable), including to the United States. You may access, erase or correct personal information we hold about you by logging into your Next Audio Labs account at any time or by making a request to us in writing. You also may object to the processing of your personal information (including for direct marketing) by making a request to us in writing.

We will process your request as soon as reasonably practicable, provided we are not otherwise prevented from doing so on legal grounds. If we are unable to meet your request, we will let you know why. We may decline to process requests that are frivolous/vexatious, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law.

Where we have obtained your consent in relation to your personal information (such as your consent to receiving marketing communications or your consent to the placement of certain types of cookies and similar technologies), you can withdraw this consent at anytime in the notifications section of your account or by changing your cookie preference.

What rights you have over your data

If you have an account on this site, have left comments or have used our Services, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
